1. By entering in RotoBowl Fantasy Football Tournament, you acknowledge that this is a competition of preparation, knowledge, and skill.
2. RotoBowl Fantasy Football Tournament participants are required to pay a $250 service fee to DBS Enterprises, LLC. This service fee covers all business costs associated to operate the event and tournament including, but not limited to registration processing, website development, maintenance, and hosting, hall rental, and event management. For Atlantic City draft participants, there is an optional additional Co-Owner service fee of $50. This $50 service fee covers the additional costs associated of hosting an additional person at the event hall. Paying this $50 Co-Owner service fee allows for up to 1 co-owner to attend all RotoBowl event functions on September 8, 2007 and it classifies the Co-Owner as a RotoBowl participant. The Co-Owner fee reserves 1 additional seat at the Live Draft at the Atlantic City Convention Center on September 8, 2007 and full participation in all RotoBowl events that day and throughout the course of the season. DBS Enterprises, LLC recognizes the Primary Team Owner (or Primary Participant) as the contact source for all correspondence on RotoBowl matters. Online draft participants may have co-owners, but will not be responsible for the additional $50 co-owner fee. Only full payment of the $250 service fee (or $300 w/ co-owner) will be accepted. Partial payment deposits will not be accepted. Complete refunds will be granted if requested by August 1, 2007. After August 1, 2007, all payments are non-refundable. There are 2 exceptions in which payments will be refundable after August 1, 2007: (1) If the participant registers and a full individual league of 12 cannot be filled, that participant’s registration will be cancelled and his/her full payment will be refunded via US Mail postmarked within 72 hours of cancellation. (2) In the unlikelihood that RotoBowl does not receive enough entries to hold the event, DBS Enterprises, LLC reserves the right to cancel the event by Sept 6, 2007. If this occurs, there are 2 options: (a) All RotoBowl participants will be given the choice to agree to participate in RotoBowl at a revised prize system or (b) DBS Enterprises, LLC will refund all RotoBowl participants’ payments in full via US Mail postmarked within 72 hours of cancellation. In the event of any cancellation (individual team or event cancellation), DBS Enterprises, LLC is only responsible for the registration cost of RotoBowl ($250/$300 with co-owner). Any other costs associated with the RotoBowl, including, but not limited to travel expenses or hotel reservations, are not the responsibility of DBS Enterprises, LLC or any of its associates.
3. A participant can register for multiple teams. Multiple teams that are owned by one participant will be placed in separate leagues.
4. All RotoBowl prize winners (both regular season winners and post season winners) will be notified of their prizes through email or US Mail postmarked by January 6, 2005. Winners must return via U.S. mail an affidavit of eligibility and a liability/publicity release (unless prohibited by law) within 15 days following attempted prize notification. When a RotoBowl participant accepts a prize, the participants also grant permission to DBS Enterprises, LLC to use their names and/or likenesses for publicity and promotional purposes without further compensation, unless prohibited by law, and agree to execute a written consent. DBS Enterprises, LLC reserves the right to file a Form 1099 for RotoBowl winners. All RotoBowl winners consent to give DBS Enterprises, LLC their social security numbers if needed. RotoBowl winners will be provided with any necessary tax documents. DBS Enterprises, LLC recommends that all RotoBowl participants consult their income tax advisor for filing advice.
5. Prize money will be sent via US Mail to winners in check form within 15 days of receipt of the winner’s signed affidavit and release. All prize checks will be made out directly by DBS Enterprises, LLC to only the Primary Team Owner (or primary participant) as stated in the RotoBowl Registration Application. DBS Enterprises, LLC is not bound by any agreement between the principal participant and any third parties regarding apportionment of the prize money. Any interest accrued to prize money does not convey to the prizewinner. Any non-cash prizes may not be substituted by cash, or by a prize of equal or greater value, unless specifically noted.
6. All RotoBowl participants may access their teams through www.rotobowl.com. All team transactions – free agent bidding, roster substitutions, etc – can be performed through www.rotobowl.com. In the case of an official change in statistics to the official stat feed, RotoBowl reserves the right to recalculate the scores from the previous week for any scoring discrepancy reported by 12:00PM EST on Thursday of the following week. In these cases, RotoBowl will promptly recalculate scores and standings and update the commishsports.com pages accordingly. All standings and scores will become official at Noon Eastern on Thursdays. DBS Enterprises, LLC holds no responsibility for any Internet problems that may result in the inability of participants to reach RotoBowl.com for any reason. DBS Enterprises, LLC holds no responsibility for any technical malfunction of any equipment or software dealing with internet service, cable network, telephone line, fax line, or telephone network. DBS Enterprises, LLC holds no responsibility for the failure of receipt of any email a RotoBowl contestant may send or receive relating to RotoBowl Fantasy Football Tournament. DBS Enterprises, LLC holds no responsibility for any computer hardware or software damage a virus or computer bug may cause for a viewer of RotoBowl.com.
7. Any form of gambling associated with RotoBowl Fantasy Football Tournament is illegal.
8. All RotoBowl participants agree to behave in a civil and lawful manner on Draft Day events and throughout the course of the season via RotoBowl.com. If during the draft, a participant’s behavior is deemed to be inappropriate or disruptive by the RotoBowl or Atlantic City Convention Center staff, that participant will be removed from the premises and a surrogate drafter will be provided to finish the draft. DBS Enterprises, LLC is not responsible for the destruction or loss of property or for physical injury (including death) due to the behavior of any, including himself/herself. Any RotoBowl participant engaging in unlawful behavior on Draft Day events and throughout the course of the season via RotoBowl.com could be subject to legal prosecution.
9. DBS Enterprises, LLC has taken extraordinary measure to greatly reduce the possibility of collusion between RotoBowl participants. Any RotoBowl participant who participates in collusion in an effort to alter the RotoBowl standings could be prohibited from winning any prize money and have their teams taken over by a surrogate of DBS Enterprises, LLC.
10. Any attempt by an individual(s) to intentionally interfere with any RotoBowl event or the operation of RotoBowl.com is a criminal act. Individuals suspected of deliberately damaging or attempting to undermine the legitimate operation of any business operation of DBS Enterprises, LLC will be prosecuted to the fullest extent of the law.
11. Personal information that is collected by DBS Enterprises, LLC through RotoBowl.com or through US Mail for RotoBowl Registration is used in the following manner, unless specifically noted in the section where the information was collected: (1) DBS Enterprises, LLC may on occasion use your personal information to contact you for newsletters, promotional offers or to solicit feedback. (2) DBS Enterprises, LLC may share aggregated used data with business partners, sponsors or other third parties for the purposes of developing content and ensuring relevant advertising and content. Such data will never be used to identify individual users unless consent is given by the user.
12. DBS Enterprises, LLC holds the right to alter any aspect of the RotoBowl regular schedule or post season schedule at any time for any unforeseen reason. In the unlikelihood of this occurrence, all RotoBowl participants agree to accept the schedule amendments. DBS Enterprises, LLC also holds the right to alter any rule aspect until September 8, 2007.
13. RotoBowl participants residing in the following states are not eligible to take part in the RotoBowl prize system: Arizona, Kansas, Louisiana, Montana, Iowa, and Utah. RotoBowl primary participants who reside in these states agree to donate any prizes they may win to the charity of their choice. DBS Enterprises, LLC, in the RotoBowl primary participant’s name, will give the prizes to the chosen charity.
14. Residents of Vermont and Connecticut are not permitted to submit their $250/$300 service fee online via Paypal. These residents must mail their service fee to DBS Enterprises, 6-05 Saddle River Rd #120, Fair Lawn, NJ 07410.
15. RotoBowl Fantasy Football Tournament is owned and operated solely by DBS Enterprises, LLC. DBS Enterprises business address is 6-05 Saddle River Rd. #120, Fair Lawn, NJ 07410.
16. By entering in RotoBowl Fantasy Football Tournament, you (1) acknowledge acceptance of these rules and agree to adhere to and be bound by them, and (2) acknowledge that DBS Enterprises, LLC or any of its associates, including but not limited to the Atlantic City Convention Center and EMap Metro, LLC are not responsible or liable for any damage, loss or injury (including death) resulting from any participant's activity in RotoBowl and related events, and/or acceptance and use of any prize won and (3) agree to hold DBS Enterprises, LLC harmless from any and all typographical, statistical, transaction, and communication errors or omissions.
17. DBS Enterprises, LLC, RotoBowl Fantasy Football Tournament, and RotoBowl.com are in no way affiliated with the National Football League or the NFL Players' Association.
